Det \u00e4r anledningen till att Europar\u00e5det klubbade igenom Mobilitetspaketet 2020. \u00c5r 2022 ut\u00f6kades paketet med fler regleringar f\u00f6r en mer j\u00e4mlik transportbransch. Och det v\u00e4lkomnar vi. Men som det gamla tales\u00e4ttet lyder: smakar det s\u00e5 kostar det.<\/strong><\/p>\n\n\n\n<p>Augusti 2020 kom de f\u00f6rsta direktiven som f\u00f6rbj\u00f6d mer \u00e4n 45 timmar veckovila i lastbilshytten. Samtidigt skulle chauff\u00f6ren ges m\u00f6jlighet att \u00e5terv\u00e4nda till \u00e5keriets hemland var fj\u00e4rde vecka. I februari i \u00e5r kom fler direktiv. Vad de inneb\u00e4r tar vi en n\u00e4rmare titt p\u00e5 h\u00e4r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Styr chauff\u00f6rernas l\u00f6ner<\/h2>\n\n\n\n<p>F\u00f6r att f\u00f6rklara EU:s mobilitetspaket och dess konsekvenser inom transportbranschen, finns en rad nyckelbegrepp att h\u00e5lla koll p\u00e5. Ett av de viktigaste \u00e4r utstationeringsdirektivet vid s\u00e5 kallad cabotage och cross trade-transporter.<\/p>\n\n\n\n<p><strong>Utstationeringsdirektivet <\/strong>\u00e4r det krav som st\u00e4lls p\u00e5 att arbetsgivare som utstationerar f\u00f6rare inom EU\/EES ska l\u00e4mna in en utstationeringsdeklaration till EU. Dessutom ska f\u00f6raren kunna visa upp en kopia av utstationeringsdeklarationen vid en kontroll. Chauff\u00f6ren m\u00e5ste \u00e4ven rapportera i sin f\u00e4rdskrivare n\u00e4r hen korsar en landsgr\u00e4ns och hur l\u00e4nge hen stannar i varje land. Lite som elitidrottare m\u00e5ste ber\u00e4tta var de \u00e4r om dopingkontrollanter g\u00f6r ett oanm\u00e4lt bes\u00f6k.<\/p>\n\n\n\n<p><strong>Cabotage&nbsp;<\/strong>\u00e4r kort sagt en yrkesm\u00e4ssig transport av gods utf\u00f6rt av ett \u00e5keri registrerat i ett annat land \u00e4n d\u00e4r godstransporten utf\u00f6rs. Man kan s\u00e4ga att det \u00e4r som en tillf\u00e4llig inrikestransport. I Sverige f\u00e5r utl\u00e4ndska \u00e5kerier utf\u00f6ra tre cabotage-transporter inom en sjudagarsperiod.<\/p>\n\n\n\n<p><strong>Cross trade-transporter<\/strong>&nbsp;utf\u00f6rs mellan l\u00e4nder d\u00e4r dragbilen inte \u00e4r registrerad. Till exempel ett polskt \u00e5keri som utf\u00f6r transporter mellan Sverige och Tyskland.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mycket administrativt arbete&nbsp;<\/h2>\n\n\n\n<p>Enkelt f\u00f6rklarat ser regleringen till att chauff\u00f6rens l\u00f6n regleras efter lagstadgade l\u00f6ner i l\u00e4nderna d\u00e4r godset lastas och lossas. Men vad h\u00e4nder om gods k\u00f6rs mellan l\u00e4nder d\u00e4r lastbilen inte \u00e4r registrerad \u2013 och m\u00e5ste korsa ytterligare l\u00e4nder f\u00f6r att n\u00e5 sin slutdestination? I de fallen regleras l\u00f6nen enligt villkor som g\u00e4ller i landet d\u00e4r dragbilen \u00e4r registrerad.<\/p>\n\n\n\n<p>Redan h\u00e4r ser vi att reglerna kr\u00e4ver en stor administrativ insats, b\u00e5de av \u00e5kerierna och chauff\u00f6rerna ute p\u00e5 v\u00e4garna. Alla vet ju att administrativt arbete kostar. Och den kostnaden p\u00e5verkar fraktpriset i slut\u00e4ndan.<\/p>\n\n\n\n<p>Alla \u00e5kerier som utf\u00f6r cabotage och cross trade-transporter enligt utstationeringsdirektivet m\u00e5ste registrera sina chauff\u00f6rer i EU:s webb-app IMI (<a href=\"https:\/\/ec.europa.eu\/internal_market\/imi-net\/index_en.htm\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Internal Market Information System<\/strong><\/a>). IMI \u00e4r ett s\u00e4kert och flerspr\u00e5kigt online-verktyg som underl\u00e4ttar informationsutbytet mellan de offentliga myndigheter som sk\u00f6ter det praktiska genomf\u00f6randet av EU-lagstiftningen.<\/p>\n\n\n\n<p>IMI hj\u00e4lper helt enkelt myndigheter att uppfylla sina skyldigheter f\u00f6r gr\u00e4ns\u00f6verskridande administrativt samarbete. Arbetsmilj\u00f6verket \u00e4r ansvarig myndighet i Sverige.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kombidirektivet ers\u00e4tts med cabotage-regler<\/h2>\n\n\n\n<p><strong>Kombidirektivet <\/strong>kallas regleringen som till exempel anv\u00e4nds i samband med internationella transporter som sker intermodalt via hamnar och j\u00e4rnv\u00e4gsstationer. Direktivet inneb\u00e4r att ett \u00e5keri kan lasta eller lossa internationellt gods inom en radie om 150 km (f\u00e5gelv\u00e4gen), utan att vara utstationerad. Kombidirektivet har tidigare anv\u00e4nts i Sverige. Direktivet \u00e4r dock ersatt av cabotage-regler. Hur man v\u00e4ljer att g\u00f6ra \u00e4r upp till respektive medlemsland. Ett land kan allts\u00e5 v\u00e4lja om det vill ha kvar kombidirektivet eller ers\u00e4tta det med cabotage-regler. Sverige har valt det sistn\u00e4mnda.<\/p>\n\n\n\n<p>Det har \u00e4ven inf\u00f6rts ett direktiv som inneb\u00e4r att det m\u00e5ste g\u00e5 minst fyra dygn efter utf\u00f6rd cabotage-transport, innan ett \u00e5keri kan \u00e5terv\u00e4nda f\u00f6r att utf\u00f6ra nya cabotage-transporter. Att k\u00f6ra bilaterala transporter \u00e4r dock okej. Dessutom m\u00e5ste varje dragbil som \u00e4r ute p\u00e5 Europas v\u00e4gar \u00e5terv\u00e4nda hem till \u201dbasen\u201d (det land d\u00e4r bilen \u00e4r registrerad) var \u00e5ttonde vecka. Vilket i praktiken kan betyda en hel del tomma transporter d\u00e5 det inte fraktas lika mycket gods fr\u00e5n Sverige ner till \u00d6steuropa.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Vilar ett ansvar<\/h2>\n\n\n\n<p>Att ha sina papper i ordning \u00e4r otroligt viktigt eftersom det \u00e4ven vilar ett ansvar p\u00e5 transportk\u00f6paren. Om ett \u00e5keri inte har koll p\u00e5 dokumentationen och ett fel uppt\u00e4cks vid inspektion, kan \u00e4ven transportk\u00f6paren d\u00f6mas f\u00f6r lag\u00f6vertr\u00e4delse. Anledningen \u00e4r att det finns ett best\u00e4llaransvar kopplat till bland annat utstationeringsdirektivet. Vid uppt\u00e4ckt fel kan ett \u00e5keri till exempel d\u00f6mas till att betala en sanktionsavgift p\u00e5 upp till 6 000 euro&nbsp;som ska betalas p\u00e5 plats. Och innan ekipaget kan forts\u00e4tta f\u00e4rden, samt beroende p\u00e5 \u00f6vertr\u00e4delsens omfattning, m\u00e5ste dragbilen bytas ut och l\u00e4mna landet.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I grunden bra<\/h2>\n\n\n\n<p>Fast vi f\u00e5r vi inte gl\u00f6mma att EU:s mobilitetspaket \u00e4r n\u00e5got v\u00e4ldigt bra \u2013 parollen \u201dlika l\u00f6n f\u00f6r lika arbete\u201d \u00e4r n\u00e5got vi p\u00e5 DB Schenker st\u00e4ller oss bakom till hundra procent. Men man m\u00e5ste ocks\u00e5 r\u00e4kna med att det kommer kosta. Och eftersom paketets senaste regleringar b\u00f6rjade g\u00e4lla i februari 2022 \u00e4r det f\u00f6r tidigt att s\u00e4ga hur det kommer sl\u00e5 mot branschen i stort.<\/p>\n\n\n\n<hr class=\"wp-block-separator is-style-wide\"\/>\n\n\n\n<p><em>N\u00e4sta del av \u201dD\u00e4rf\u00f6r \u00f6kar fraktpriserna\u201d handlar om containerkaoset orsakat av pandemin.
